1. Acceptance of Terms

By installing, accessing, or using the Vocalario Chrome extension ("the Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Extension.

These Terms constitute a legally binding agreement between you and Vocalario ("we," "us," or "our").

2. Description of Service

Vocalario is a Chrome browser extension that helps users learn vocabulary from web content. The Extension provides:

• Vocabulary extraction and analysis from webpages
• Integration with third-party AI providers (OpenAI, Anthropic, Google Gemini)
• Local storage of vocabulary data on your device
• Language learning tools and features

The Extension is provided free of charge. However, you are responsible for any costs associated with third-party AI provider API usage.

3. User Requirements

To use Vocalario, you must:

• Have a compatible Chrome browser
• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Obtain and maintain your own API key(s) from third-party AI providers
• Comply with all applicable laws and regulations

4. User Responsibilities

You are responsible for:

• API Keys: Obtaining, securing, and maintaining your own third-party AI provider API keys
• API Costs: All charges incurred from using third-party AI services
• Content: Ensuring you have the right to analyze and process webpage content
• Compliance: Using the Extension in compliance with all applicable laws
• Security: Keeping your API keys and device secure

5. Acceptable Use

You agree NOT to:

• Use the Extension for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the Extension
• Use the Extension to violate any third-party rights, including copyright or privacy rights
• Share or distribute your API keys through the Extension
• Use the Extension in a way that could damage, disable, or impair the service
• Attempt to gain unauthorized access to any systems or data
• Use the Extension to scrape or harvest data from websites without permission

6. Third-Party Services

Vocalario integrates with third-party AI providers. By using these integrations, you acknowledge that:

• You are bound by the terms of service of each AI provider you use
• We are not responsible for the availability, accuracy, or quality of third-party services
• Third-party services may change, be discontinued, or have their own fees
• You are responsible for complying with third-party provider terms and policies

7. Intellectual Property

Vocalario is open-source software. The Extension's source code is available under the terms specified in its license file in the GitHub repository.

While the code is open source, the Vocalario name, logo, and branding are our intellectual property and may not be used without permission.

• You may fork, modify, and distribute the code according to its open-source license
• You must retain copyright and license notices when distributing
• The name "Vocalario" and associated branding remain our property

8. Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Extension will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or quality of vocabulary analysis
• Warranties that the Extension will meet your requirements

We do not warrant that:

• The Extension will always be available or function perfectly
• Vocabulary analysis will be accurate or suitable for your needs
• Third-party AI services will be available or accurate
• Your data will never be lost (please backup important vocabulary lists)

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOCALARIO SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Costs of obtaining substitute services
• Damages arising from your use of third-party AI services
• Costs incurred from third-party API usage
• Damages from loss of vocabulary data

This limitation applies regardless of the legal theory (contract, tort, or otherwise) and even if we were advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vocalario and its contributors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Extension
• Your violation of these Terms
• Your violation of any third-party rights
• Your use of third-party AI services
• Any content you analyze or process using the Extension

11. Data and Privacy

Please review our Privacy Policy to understand how we handle data. Key points:

• We do not collect or store your personal data
• All vocabulary data is stored locally on your device
• Your API keys are stored securely in your browser
• You are responsible for backing up your data

12. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue the Extension at any time
• Change features or functionality
• Update the Extension without notice
• Remove support for certain AI providers

We will make reasonable efforts to notify users of significant changes through the Extension or our website.

13. Modifications to Terms

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date
• Significant changes will be communicated through the Extension or our website
• Your continued use of the Extension constitutes acceptance of updated Terms

If you do not agree to updated Terms, you should stop using the Extension and uninstall it.

14. Termination

You may stop using the Extension at any time by uninstalling it from your browser.

We reserve the right to terminate or suspend access to the Extension for users who violate these Terms, though enforcement is limited given the Extension's local-first nature.

Upon termination:

• Your right to use the Extension ceases immediately
• Local data remains on your device until you delete it
• You remain responsible for any API charges incurred before termination

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Extension shall be resolved through:

• First, good-faith negotiations between the parties
• If negotiations fail, binding arbitration or courts in Portugal

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vocalario regarding the Extension and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
